1. Description of Service

These Terms of Service are applicable to all users of Al-Madrasatu Ar-Rahmaniyyah ("AMAR," "we," "our," or the "Company"), an online Islamic education platform providing services through its website, video streaming services, and mobile applications located at rahmaniyyah.com and related domains, subdomains, and applications (individually and collectively the "Services").

These Terms govern your use of the AMAR Services, including all functionalities, features, streaming services, audio, visual, written media, downloadable resources, community features, and all content and software associated with the Services.

Our Services include, but are not limited to:

  • The AMAR Arabic Programme for classical Arabic language instruction
  • The Precision in Knowledge Programme covering six faculties of Islamic sciences
  • Live classes and pre-recorded video content
  • The AMAR Memorisation Programme for Quranic studies
  • Community forums and interactive learning features
  • Progress tracking and course completion records
  • AMAR Cares charitable initiatives
  • Dawrah Ilmiyyah retreats and Ijazah certification

2. Acceptance of Terms

By creating an account, accessing, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these Terms, you must not access or use our Services.

These Terms constitute a legally binding agreement between you and Al-Madrasatu Ar-Rahmaniyyah governing your use of our website, app, courses, and related services.

3. Changes to Terms

The Company reserves the right, at its sole discretion, to modify, add, or remove any terms or conditions of these Terms of Service at any time. Any changes to these Terms of Service shall be effective immediately following the posting of such changes.

We will notify you of material changes by email or through a prominent notice on the Services. You agree to review these Terms from time to time, and your continued use of the Services following any changes constitutes your acceptance of the updated Terms.

4. Access and Eligibility

Our Platform is open to users of all ages. However, if you are under 18 years of age (or the age of legal majority in your jurisdiction), you must have the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

Parents and guardians are responsible for the activities of minors using the Services under their supervision. All purchases and account registrations must be made by an adult with valid payment authority.

The Company makes no claims that the Services may be lawfully accessed in any specific location. Access to the Services may not be legal in certain jurisdictions. When you access the Services, you are solely responsible for compliance with the laws and regulations of your jurisdiction.

5. User Conduct

The Services may be used only for lawful purposes relating to Islamic education and personal development. The Company specifically prohibits any use of the Services for purposes other than those designated by the Company.

When using the Services, you agree to conduct yourself in accordance with Islamic etiquette (adab) and our community guidelines. You agree NOT to:

  • Harass, abuse, threaten, or intimidate other users or instructors
  • Post offensive, discriminatory, defamatory, or inappropriate content
  • Engage in spamming, phishing, or other malicious activities
  • Access data not intended for you or log into accounts you are not authorised to access
  • Attempt to probe, scan, or test the vulnerability of our systems or breach security measures
  • Interfere with service to any user, including via viruses, overloading, flooding, or crashing
  • Scrape, harvest, or collect data from the Services
  • Use automated systems or bots to access the Services
  • Violate any applicable laws or regulations

Violations of system security or inappropriate conduct may result in civil or criminal liability. We will investigate occurrences that may involve such violations and may cooperate with law enforcement authorities in prosecuting users involved in such violations.

6. Account Registration and Security

6.1 Account Creation

To access our courses, you must create an account by providing accurate and complete information, including your full name and a valid email address. You warrant and represent that all information provided is current and accurate, and will be kept up-to-date.

6.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials and are responsible for all uses of your account, whether or not authorised by you. If you wish to have someone else use your device, you must log out to ensure no other individual has access to your content.

You agree to immediately notify the Company of any unauthorised use of your account. Account sharing is strictly prohibited. Each account is licensed for use by a single individual only.

6.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or fail to pay applicable fees.

7. Use of Services

The Services are offered for Islamic education, video streaming, and related educational materials. Each user is solely responsible for deciding whether the Services are suitable for their own purposes.

The Company grants you a limited, non-exclusive, non-transferable license to access and use the Services for your own personal and non-commercial educational purposes. This includes rights to view content on the Company's website and applications.

If you elect to access any component of the Services for which there is a fee, you agree to pay all fees and charges associated with your account on a timely basis.

8. Subscriptions and Purchases

The Services allow you to access digital content on a lifetime access, subscription, or individual purchase basis. The basis on which digital content is available will be indicated on the relevant product page.

We currently offer the following access options:

  • Lifetime Access: A one-time payment providing permanent access to all current and future courses and programmes
  • Monthly Subscriptions: Recurring monthly payments for access to specific programmes (when available)

Subject to your payment of applicable fees, the Company grants you a non-exclusive, non-transferable, personal, non-sublicensable, limited right and license to access the content based upon the access option selected by you.

The Company makes no guarantees as to the resolution and quality of digital content when streaming. The quality of your stream depends on various factors including your connection speed, location, device, and bandwidth.

9. Payments and Billing

All prices are displayed in US Dollars (USD). Applicable taxes may be added at checkout based on your location.

Payments are processed securely through Stripe, our third-party payment provider. By making a purchase, you agree to Stripe's terms of service. We do not store your complete payment card details on our servers.

By purchasing a payment plan, you expressly agree that we are authorised to charge your selected payment method. Receipts are sent to your registered email address upon successful payment.

9.1 Subscription Renewals

Monthly subscriptions automatically renew on the same date each month until cancelled. You may cancel your subscription at any time through your account settings or the billing portal. Access continues until the end of your current billing period.

9.2 Refund Policy

All purchases are final and non-refundable. Due to the digital nature of our educational content and the immediate access granted upon purchase, we do not offer refunds. By completing your purchase, you acknowledge and accept this no-refund policy.

9.3 Price Changes

We may change our prices at any time. For active subscribers, we will provide at least 30 days' notice before any price increase takes effect.

10. Intellectual Property

Al-Madrasatu Ar-Rahmaniyyah, AMAR, and any other Company trademarks and trade names are and shall remain the exclusive property of the Company. Any unauthorised use of such trademarks is prohibited.

The Services, including all programmes, content, interface layout, documentation, and graphics, are the sole and exclusive property of the Company and are protected by copyright, trademark, and other intellectual property laws of the United Kingdom and other countries.

All course materials, videos, text, graphics, logos, and other content are solely owned and controlled by the Company or its content providers and are protected by applicable intellectual property laws.

You may NOT:

  • Copy, reproduce, or distribute course materials
  • Record, download, or capture video content
  • Share your account or course access with others
  • Sell, modify, or use content for commercial purposes
  • Remove or alter any copyright notices
  • Create derivative works based on our content without written permission
  • Reproduce, display, publicly perform, or distribute the Services in any way

10.1 User-Generated Content

By posting content on our forums or community features, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute such content in connection with the Services.

11. Use of Software

If the Services require or include downloadable software such as a mobile application, the Company grants you a personal, limited, non-exclusive, and non-transferable license to use the software solely for accessing the Services.

You shall NOT:

  • Modify, alter, decompile, reverse engineer, or disassemble the software
  • Copy, reproduce, transmit, rent, lease, resell, sublicense, or distribute the software
  • Use the software on any device you do not own or control
  • Make the software available over a network for use by multiple devices simultaneously

The Company may, at its sole discretion, revise or update the software at any time. Your continued use constitutes acceptance of such changes.

12. Educational Disclaimer

The content provided through our Services is for educational purposes only. While we strive to present authentic Islamic knowledge from qualified instructors:

  • Our courses are not a substitute for formal Islamic scholarship or religious rulings (fatawa)
  • For personal religious matters, you should consult qualified local scholars
  • We do not guarantee the accuracy, completeness, or applicability of content to your specific circumstances

13. Warranty Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. THE COMPANY DISCLAIMS ALL WARRANTIES WITH RESPECT TO THE SERVICES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

THE COMPANY DOES NOT WARRANT THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, THAT OPERATION WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

THE COMPANY MAKES NO WARRANTIES ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF THE CONTENT OR ANY OTHER MATERIALS ACCESSED THROUGH THE SERVICES.

THE COMPANY TAKES NO RESPONSIBILITY FOR INFORMATION YOU HAVE UPLOADED AND SHALL NOT BE RESPONSIBLE FOR THE DELETION, CORRUPTION, DAMAGE, OR LOSS OF SUCH INFORMATION.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER THE COMPANY NOR ANY OF ITS AFFILIATES, SUBSIDIARIES, DIRECTORS, OFFICERS, EMPLOYEES, PARTNERS, OR AGENTS SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES RELATING TO OR RESULTING FROM YOUR USE OF THE SERVICES.

THESE INCLUDE BUT ARE NOT LIMITED TO DAMAGES FOR ERRORS, OMISSIONS, INTERRUPTIONS, DEFECTS, DELAYS, LOST PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, UNAUTHORISED ACCESS, AND OTHER TANGIBLE AND INTANGIBLE LOSSES.

THIS LIMITATION APPLIES REGARDLESS OF WHETHER THE DAMAGES ARE CLAIMED UNDER CONTRACT, TORT, NEGLIGENCE, OR ANY OTHER LEGAL THEORY, AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THE COMPANY'S MAXIMUM LIABILITY ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

15. Indemnification

You agree to defend, indemnify, and hold harmless the Company and its subsidiaries, affiliates, officers, directors, employees, agents, and partners from and against any loss, liability, claim, action, or demand, including reasonable legal fees, arising from or relating to:

  • Your use of the Services
  • Any content you submit or post
  • Your breach of these Terms
  • Your violation of any third-party rights

16. Communications

By using the Services, you consent to receive electronic communications from the Company. These communications will include emails about your account, access, transactional information, course updates, and other information related to the Services.

You may opt out of marketing communications at any time through your account settings or the unsubscribe link in any marketing email.

17. Termination

17.1 Your Rights

You may cancel your subscription or close your account at any time through your account settings. Lifetime access holders retain access to their purchased content indefinitely, subject to these Terms.

17.2 Our Rights

We may suspend or terminate your account immediately if you violate these Terms. Upon termination for cause, you forfeit all access to the Services and any fees paid.

17.3 Effect of Termination

Upon termination, your license to access course content ends immediately. Provisions regarding intellectual property, limitation of liability, indemnification, and dispute resolution survive termination.

18. Governing Law and Disputes

These Terms of Service shall be governed by and construed in accordance with the laws of England and Wales or the United Arab Emirates, depending on your place of residence, without regard to conflict of law principles and excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

For users residing in the United Kingdom or Europe, you irrevocably consent to the exclusive jurisdiction of the courts of England and Wales. For users residing in the Middle East, Asia, or Africa, you irrevocably consent to the exclusive jurisdiction of the courts of the United Arab Emirates. For users in other regions, disputes may be brought in either jurisdiction at the Company's discretion.

Any disputes arising from these Terms or your use of the Services shall first be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the appropriate jurisdiction as outlined above.

19. General Provisions

Nothing in these Terms is intended to create or will be construed as creating a joint venture, partnership, employer/employee, or principal/agent relationship between you and the Company.

If any provision of these Terms is found to be invalid or unenforceable, such provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall continue in full force and effect.

The failure or delay of either party to exercise any right does not constitute a waiver of such right and shall not affect that party's right to later enforce it.

You may not assign these Terms or any of your rights or obligations without our prior written consent.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Al-Madrasatu Ar-Rahmaniyyah regarding your use of the Services.
